Muir Burgos had been arrested on March 16, when he was still 16 years old, after the demonstrations on March 13 in Morón, a municipality in the province of Ciego de Ávila. The protests occurred in a context of prolonged blackouts and shortages of food and basic necessities.

Arrest, accusation and prison in Canaleta

The teenager was detained with his father, the evangelical pastor Elier Muir Ávila, after both attending a police summons in Morón. The father was released that same day; Jonathan was placed under provisional prison accused of “sabotage”, one of the most serious crimes in the Cuban Penal Code, with sentences of up to 15 years in prison.

He remained in the Canaleta prison, a maximum security penitentiary center for adults in Ciego de Ávila. Relatives, human rights organizations and independent media reported that a minor was detained with adults, with precarious conditions, visiting restrictions and health problems - including a chronic dermatological disease and pending medical treatment -, according to documentation collected by the Inter-American Commission on Human Rights (IACHR) and Amnesty International.

International pressure before liberation

The case generated reaction outside Cuba. The US State Department demanded on several occasions the immediate release of the minor; Deputy Undersecretary Riley Barnes asked the regime to release him “along with all political prisoners unjustly detained,” according to 14ymedio.

On April 24, the IACHR granted precautionary measures in favor of the adolescent, considering that his rights to life, personal integrity and health were at risk of "irreparable harm." The organization requested measures with a focus on age, medical care, communication with family members and lawyers, and detention conditions compatible with international standards. The Cuban State did not respond to the request for information sent on April 9.

On May 19, Amnesty International launched an urgent action calling for the immediate release of Muir Burgos and his protection from violence and ill-treatment in adult prison.

The release puts an end, at least for the moment, to the teenager's stay in Canaleta. No details have immediately emerged about the legal modality of the release nor about whether the criminal process for the crime of "sabotage" remains open.
